Dealing with Insurance Companies One of the most important (and hardest) things for any personal injury attorney to do is to protect their client after the client has been injured in an accident – either on the job or on the road. Our job as personal injury lawyers means that we must ensure that our client not only receives fair treatment in the courts, but also that they receive the proper medical attention and care that they deserve. And once treatment begins, we advise our clients to continue treatment. There should never be breaks in treatment schedules. No physician would ever advise to suspend treatment. First, it’s next to impossible to get better if you don’t stick to a treatment schedule and it will also call into question the legitimacy of the claim since breaks in treatment would require an explanation. Determining damages Given the timetable to convey a demand to an insurance company, a personal injury attorney should exercise caution in filing a claim too hastily. Accurately determining the scope of injuries is important, as is ensuring that all injuries have been uncovered. If the case involves an auto accident, the attorney must research and list all potential monetary damages. In addition to the damage to the vehicle, was the client or their family members hurt? Did the injuries require a hospital stay and, if so, how do we determine the amount of lost wages incurred due to the accident? For an injury that occurs at work, there are several factors to consider as well. Again, injury to the client is the first step, followed by the lost wages the client incurred due to the injury. Hospital and doctor bills must also be tallied. There are also differences between such cases. While auto accidents are bound by traffic laws, workplace accidents involve worker’s compensation claims and, sometimes, negligence. It’s important to remember that damages are not limited to just current medical bills. All future medical bills as well as pain and suffering claims are also considered areas any personal injury attorney must fully investigate on behalf of their client. Resolution Resolving a case with an insurance company is a serious matter. It shouldn’t be rushed and many times the law allows for a significant time frame in which to truly discover all injuries and aftereffects of the accident. Waiting the advised amount of time to make sure that all injuries are noted can only improve the accuracy of the injured party’s claim. Patience is required before any insurance claim is made – an important point to remember as mounting medical bills can be a factoring pressure for many clients. Knowing the proper way to handle this pressure can be a valuable asset for any personal injury attorney.
